What Is the Role of Immigration Lawyer?

Attorney Kevin Beigel is the founder of Beigel Law firm. Kevin Beigel’s Toronto, Canada-based firm specializes in American and Canadian immigration law.

People relocating from their home country to the United States or Canada may need to hire an immigration attorney to advise them. An immigration attorney can assist persons who are immigrating or have immigrated to the US or Canada in issues with visa applications, employment, study, deportation, refugee or asylum claims, citizenship, and naturalization.

There are several instances when it would be in an immigrant’s best interests to hire an immigration attorney. Examples of such situations include:

- those with prospective employers who are not helping with their immigration;

- those who have been denied a visa, and

- those who have been deported from another country.

Immigrants in the following situations may also benefit from hiring an immigration attorney:

- Those with a medical condition,

- Those who have been waiting too long for their immigration papers with no reasonable explanation for the delay, and

- Immigrants with criminal records,

Specialist Certification through the LSO

Accomplished Ontario lawyer, Kevin Beigel, has practiced as a senior attorney at Beigel Law in Toronto for the past 12 years. Kevin Beigel was admitted to the Ontario Bar in 1996 and has been certified as a specialist in immigration law by the Law Society of Ontario since for more than 15 years.

Known as the Law Society of Upper Canada until 2017, the Law Society of Ontario (LSO) has governed the standards of lawyers and paralegals in Ontario for nearly 225 years. In addition to its other areas of skill competency and professional competency oversight, LSO certifies qualifying attorneys in 17 different areas of specialization.

Attorneys cannot apply for certification in one of these areas without at least seven years of practice experience in general, with at least five of those years in their chosen area of specialization. They also must comply with LSO professional standard requirements.

Each area of practice has its own specific certification restrictions. Immigration attorneys, for example, must demonstrate a percentage of cases in immigration law or refugee protection. They also must submit references from four legal practitioners in Ontario.

The Role of the Appellate Division of the New York Supreme Court

A native of Toronto, Ontario, Kevin Beigel is an experienced attorney who received his law degree from the University of Western Ontario. Kevin Beigel worked for a prominent corporate immigration law firm in Toronto for five years before opening Beigel Law, his own immigration law firm. To augment his work, he is associated with the Appellate Division of the Supreme Court in New York.

The New York State constitution was signed in 1894 and included the creation of the Appellate Division of the Supreme Court. New York state has four appellate court locations that serve different areas, with the first division serving New York and Bronx counties. Part of the court's role is to hear appeals, but it requires the court’s permission, and a case may have to be heard at the Appellate Term, a lower court, before being heard by the Appellate Division. Appeals from criminal court, family court, and the surrogate court can all be heard here.

The Appellate Division is also responsible for admitting new lawyers to the bar, and they average about 3,000 new lawyers each year. In addition, the division hands out disciplinary measures to lawyers who have been found guilty of wrongdoing.
